Unless I am misinterpreting the still-frame, that's a boot, on a foot. The driver (or someone else in the cab) stuck his leg out of the door.
If that's what happened, there was risk of injury to both people... but since a leg isn't rigid (it can swing and bend at the knee) there might have been less risk of injury to the kid than if he'd been hit by a metal objection sticking out of one of the train cars a few seconds later.

I would guess the open frame is strictly for engine/drive train testing. I am really looking forward to this car and hope it is successful. I'm already planning customizations for mine. Here is a Photoshop paint job someone did.

One eifficulty I foresee... the occasional gangs of hooligans carrying out the "Smart car tipping" craze could have a field day with these little beauties. They could practically walk away with one in their pockets, rather than just tipping it over or tosing it into a canal.
You might have to treat one of these a bit like a high-value bicycle, and chain it up when not using it.
The main problem I have with it at the moment is how they "anticipate" getting a good safety rating and "hope" to have easy availability of repair parts. It would be nice to have everything actually settled and confirmed before rushing out and buying one. Having to ship my vehicle off to Macau just to change a headlight bulb would be rather trying.
Then there's the matter of local laws. Some jurisdictions may classify it as a car, others as a motorcycle, perhaps others as an infernal contraption. . .you could end up in a bit of trouble in your travels. And depending on its top speed, there may be some roads it would not be allowed on.
Maybe if it gains popularity, those issues will be resolved.
Other than that, the only problems I see with it are the lack of cargo space inside (which isn't a problem any different from owning a motorcycle, meaning that you'll just have to make other plans for when you go shopping at the local lumber yard) and the fact that it seems to only have a couple of inches clearance above the road (I can foresee those things getting stuck on many of the railroad crossings and steep grades around here).
